Please read these Terms of Use ("Terms") carefully before using the VapeQuit mobile application (the "App") operated by VapeQuit ("we," "our," or "us").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the App.

Acceptance of Terms

By accessing or using VapeQuit, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the App.

Eligibility

You must be at least 13 years old, or the minimum age required in your country of residence if higher, to use VapeQuit. By using the App, you represent and warrant that you meet this minimum age requirement and have the legal capacity to enter into these Terms.

License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use VapeQuit on your personal iOS device for your personal, non-commercial use.

This license does not include the right to:

• Copy, modify, or create derivative works of the App.
• Reverse engineer, decompile, or disassemble the App.
• Remove, alter, or obscure any proprietary notices or labels on the App.
• Use the App for any commercial purpose or in any way that violates applicable laws or regulations.
• Share your account or allow others to use the App through your account.

User Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account and device.
• All activities that occur under your account or on your device.
• Ensuring that your use of the App complies with all applicable laws and regulations.
• Providing accurate and truthful information when using the App.

You agree not to:

• Use the App in any unlawful manner or for any unlawful purpose.
• Interfere with or disrupt the App's functionality or servers.
• Attempt to gain unauthorized access to the App or related systems.
• Use automated systems or bots to access or use the App.
• Transmit any viruses, malware, or harmful code through the App.

Not a Substitute for Medical Advice

IMPORTANT: VapeQuit is a self-help tool designed to support your journey to reduce or quit vaping. The App is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

VapeQuit does not provide medical advice, diagnosis, or treatment. The information and features provided by the App are for informational and motivational purposes only and should not be considered as a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding your health, nicotine use, or any medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or learned through the App.

If you are experiencing severe withdrawal symptoms, health complications, or any medical emergency related to nicotine use, contact a healthcare professional or emergency services immediately.

In-App Purchases

VapeQuit may offer in-app purchases for premium features. All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions. Prices and availability of in-app purchases are subject to change without notice.

Refunds for in-app purchases are handled by Apple in accordance with Apple's refund policy. We do not process refunds directly.

Intellectual Property

The App, including its design, features, content, and functionality, is owned by VapeQuit and is protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks, logos, or other proprietary information without our prior written consent.

User Content

You retain ownership of any data, information, or content you enter into the App ("User Content"). By using the App, you grant us a limited, non-exclusive license to use, store, and process your User Content solely for the purpose of providing and improving the App's services.

You are solely responsible for your User Content and warrant that it does not violate any third-party rights or applicable laws.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VAPEQUIT AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE ACTION GIVING RISE TO THE LIABILITY, OR $50, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not guarantee that the App will meet your requirements or that any results obtained from using the App will be accurate or reliable.

Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease. You may terminate your use of the App at any time by deleting the App from your device.

Provisions of these Terms that by their nature should survive termination shall survive termination, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

Changes to Terms

We reserve the right to modify or update these Terms at any time. We will notify you of any material changes by posting the updated Terms in the App or on our website and updating the "Last updated" date.

Your continued use of the App after any changes to these Terms constitutes your acceptance of those changes. If you do not agree to the modified Terms, you must stop using the App.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in the United States.

If you are located outside the United States, these Terms shall be governed by the laws of your jurisdiction to the extent required by applicable law.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and VapeQuit regarding your use of the App and supersede all prior agreements and understandings.
